* ENTIRE AGREEMENT This agreement contains the entire understanding between the photographer and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement that does not mean that any other provision is waived. Please be on time for your appointment, as we may be be scheduling several sessions in one day. Hair & make up start at appointment start time. If you are late, your appointment will remain for the time contracted, not for the amount of time booked. You may add more time if Studio time is available. Image Selection will be at the sole discretion of the Photographer. Images not selected will be discarded. Full sessions may go much longer than mini sessions depending on location and wardrobe changes. Following your session you receive a link to your private temporary gallery and select the images you would like printed.
* Couples sessions: A $150 fee is added to all couples sessions. Please also note we do not photograph acts of sex, boudoir sessions capture intimate and suggestive posed images there is no penetration. I also do not photograph male nudity. i do have other photographers in my studio collective who don’t have these rules on male nudity
* A booking fee of $100 in addition to any location rental fee is required to reserve your session date and time. The remainder is due 1 week before your session.
* BOOKING FEE, PAYMENTS & RESCHEDULING A non-refundable booking fee of $100, plus any applicable location rental fee, is required to reserve your session date and time. By submitting the booking fee, the Client agrees to commit to the reserved session date.The remaining balance is due no later than one (1) week prior to the session date. Failure to pay the balance in full may result in cancellation of the session without refund of the booking fee.Rescheduling requests must be submitted in writing. Any rescheduling is subject to studio availability and a non-refundable reschedule fee of $125, which will be added to the remaining session balance. Only one reschedule will be permitted per booking. Session
* Confirmation & Attendance Policy
Session Confirmation & Attendance Policy The photographer will send a confirmation message with reminders the day before the scheduled session. The client must confirm attendance at least 3 hours prior to the session start time. If the client does not respond or confirm attendance within this time frame, the session will be considered unconfirmed and may be cancelled at the photographer’s discretion. In the event of a cancellation due to an unconfirmed session, the client remains responsible for any applicable session fees as outlined in this agreement.
* LIMIT OF LIABILITY. Client acknowledges and understands that the Photographer(s) cannot guarantee that any specific photo will be taken. The Photographer(s) will make every effort to accommodate Client’s wishes and acknowledges that there is a reasonable expectation of professional quality consistent with the photographers work.
The client understands that the work on display through websites, prints, ect. has been retouched and the client will get un-retouched digital proofs, additionally retouching outside what is included in the package will incur an extra fee.
The Photographer(s) cannot be held liable for factors over which they have no control which may affect the quality of the photographs, such as Client lateness condition of the shooting space (if at the clients home)and photogenicity. Additionally, The Photographer(s) cannot be responsible for the effects of the subjects’ physical appearance including body position, facial expressions, blinking or clothing. The Photographer(s) has the right to refuse to produce any image that could violate libel or copyright laws, or in the course of its production could cause or contribute to bodily injury, death, equipment damage or property damage or destruction.
*Digital and printed images are not included with the session unless otherwise noted in the package details. images you choose to purchase must be selected from a secure gallery. please refer to our print menu for rates and additional print packages.
* PRICING and PRODUCTS. Pricing is defined on The Photographer(s)’ standard price list in effect at the date of this contract. Orders placed after the event are billed at the rates in effect on the most recently published price list. Credits included in covered package are not redeemable as cash or as a deduction from coverage package price. the number of Client chosen photographs included in an album is limited based on the size and selection of album chosen (which is specified on our most current price list). Inclusion of additional images will require an upgrade in the number of book pages. Any additional retouching requested by Client will be billed at $60 per hour or $60 per image, which ever is greater. Products are subject to availability from the manufacturer. Shipping and handling charges are not included unless otherwise stated.
* HAIR & MAKEUP: If you have any problems or issues with makeup or hair please let your makeup artist know
before the shoot. Re-shoots will not be done for reasons of hair, makeup or wardrobe.
*LOCATION LIABILITY: on location shoots are done at your own risk. Some environments are inherently dangerous and because of this Boudoir-NY cannot and will not be held responsible for any injury to person or property resulting from environmental risk or accidents IE cars and traffic or abandoned structures collapsing. In addition we make our best attempt to arrange privacy but as we commonly shoot in public spaces such as water falls and open fields we cannot fully control the location. Please be aware that if shooting out doors you may be seen by the public
* NOTICE OF COPYRIGHT. It is illegal to copy or reproduce the photographs, digital files without the Photographer’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties. If the client purchases digital negatives they are allowed to make reproductions of photographs for their own personal use, all other reproductions must go through Boudoir-NY.
* PRIVACY STATEMENT: All information provided via any of the intake forms on this site will NOT be shared with any third parties. Images with any nudity or implied nudity will not be posted online or for advertisement without your permission as stated in our model release (please see bottom of page for model release).
* MODEL/EXHIBITION/RELEASE: The Photographer retains ownership of digital originals and the unrestricted right to copyright, use and publish images resulting from this assignment for commercial, promotion, competition or other purposes such as, but not limited to, print ads,brochures,websites,exhibits and other promotions without compensation or liability to the client.
Image Archival The photographers will keep your digital images on file for 6 months from the date of the session, so that you may request additional services and or products sourced from the original images, Example: photo albums, prints, more in depth editing. These additional products or services may come at additional expense.
Extended Storage of images: At the request of the client, Images may be kept longer than 6 months up to a maximum of 1 year. There will be a $25 fee for each month after 6 months this fee will be added to any order placed after the 6 month archival has passed.
* Erin Braden Photography understands that boudoir photography is very personal and our studio respects your privacy. We will not share images online or in print without your permission. We never sell images to third parties. Because of this please mark the appropriate box regarding privacy & usage by our studio.
Your safety is your responsibility. I Hereby assume all of the risks of participating in this photo-session and furthermore release Erin Braden photography and its associates from any and all liability, including but not limited to, death, disability , personal injury, and property damage which may hereafter occur to me including my traveling to and from this session. I also understand that photography locations are frequently hazardous. I understand that I may be asked during the session to place myself in positions and situations that may be dangerous and that it is my responsibility to use my judgment and to refuse any position or situation that is unsafe.
DO NOT ARRIVE DRUNK !! if you are under the influence when you arrive. the session may be canceled at the photographers discretion.
